12.  Samyeli Travel General Terms and Conditions

 12.1 You are responsible for ensuring that you are at the correct departure point at the correct time. We cannot be held liable for any loss or expense incurred if you are not at the departure point at the correct time.

12.2 Samyeli Travel reserves the right to decline, accept or retain any person as a tour passenger should such person's health, mental condition, physical infirmity or general attitude impede the operation of the tour or the rights, welfare or enjoyment of other tour passengers.

 12.3 We will carry out the itinerary as printed, unless for reasons beyond our control it becomes necessary to reschedule or alter part of the itinerary. We reserve the right to do this if necessary. We also reserve the right to alter or reschedule the itinerary if the management deems it necessary to do so as to make the operation of the tour run more smoothly due to events that may have occurred which could hinder the smooth running of the tour.

12.4 Published running times of services are estimated. Services (ferries, buses, trains etc) are sometimes delayed due to industrial action, breakdowns, bad weather etc. We will not be held liable or accept responsibility for delays caused by any form or breakdown that occurs, unless it is due to negligence by Samyeli Travel. 

12.5 Arrival Airport transfers are offered from Ataturk International Airport between 6am on the 21st April and midnight on the 22nd April 2015 and transport vehicles will depart for the city once there is sufficient number of passengers to justify the journey.  If you do not wish to wait or if you arrive outside these times then please feel free to make your own way to the hotel from the airport. Transfers are also available from Sabiha Gokcen airport at selected times (please refer itineraries and FAQs) but due to the distance of this airport from the city centre we will charge a fee for this based on the number of people travelling on the transfer.

12.6 Customers booking and wishing to join a group or passengers on an earlier booking must inform us at time of booking with all necessary information.  We will do all we can to accommodate your needs but cannot guarantee that you will be on the same bus or hotels if these have already been allocated.  

12.7 If you intend to attend the Bosphorus Cruise at 14:15pm and the Gala Dinner at 19:15pm on the 22^nd April 2015 you are responsible for ensuring you arrive in your hotel in Istanbul early enough on this day to allow enough time to be transported there prior to it starting.  Samyeli Travel cannot be held responsible for your inability to attend due to flight arrival times or any delays outside of our control.

12.8 The copyright and all other rights in all of the material on this site are owned by Samyeli Travel or the material is included with the permission of the rights owner. None of the content or data found on this site may be reproduced, republished, distributed, sold, transferred, or modified without the express written permission of Samyeli Travel. But you may download, display and print one (1) copy of the materials presented on our site on a single computer for your personal, non-commercial use. Logos, pictures and service marks displayed on our site are our registered and common law Marks. Your use of and access to our site do not grant you any license or right to use any of the Marks. You may not use any robot, spider, other automatic device, or manual process to monitor materials available through our site.

12.9 You may only use our site if you are at least 18 years of age and can enter into binding contracts (our site is not available for use by minors). You are responsible for maintaining the secrecy of your personal and account information. You may only use our site to make legitimate reservations or purchases. You may not use our site: to make any false, fraudulent or speculative reservation or any reservation in anticipation of demand; to post or transmit any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law; or for any other purpose that is unlawful or prohibited by these Terms. We may, at any time and without advance notice or liability, terminate or restrict your access to all or any component of our site.

12.10 We will use our reasonable commercial efforts to keep our site available on a 24-hour/7-day-a- week basis, subject to necessary scheduled downtime for maintenance, unscheduled maintenance and system outages. Your access to our site may not be uninterrupted or available at all times. We cannot promise that our site will be error-free, that defects or errors will be corrected or that our site or the servers that make it available are free from viruses or other harmful components. You may not use any device, software or routine that interferes or attempts to interfere with the normal operation of our site or take any action that imposes an unreasonable load on our computer equipment.

12.11 Your use of our site is subject to our Privacy Policy. You have read that privacy policy and it is reasonable and acceptable to you. Your acceptance of these Terms is also your consent to the information practices in our privacy policy.

12.12 Our site may contain links to other sites that we do not operate or control. We are not responsible for these other sites. We provide these links for your reference and convenience. We do not endorse the contents of these other sites. These links are not an indication of our association with the owners or operators of any of these other sites. You are free to access these other sites, but you do so at your own risk. You agree not to create a link from any Web site, including any site controlled by you, to our site.

12.13 Samyeli Travel tries to ensure that the information on this site is accurate and complete. Samyeli Travel is not able to check the accuracy or completeness of that information and does not WARRANT THE ACCURACY, COMPLETENESS, CURRENCY OR RELIABILITY OF ANY OF THE CONTENT OR DATA FOUND ON THIS SITE. You are advised to verify the accuracy of any information before relying on it. We do not accept any liability for any losses or claims arising from any inability to access the web site, any interruption or any failure to complete a transaction. For example, SAMYELİ Travel does not take any responsibility for any discrepancy between the hotel description given in the website and the reality as the hotel descriptions have been reported exactly as given to SAMYELİ Travel by the hotel’s management or as printed in the hotel’s brochure or official hotel guide.

12.16 Your acceptance of these Terms and use of our site do not create a joint venture, partnership, employment or agency relationship with us. You may not assign, delegate or transfer your rights or obligations under these Terms. We may modify these Terms, at any time, by posting conspicuous notice on our site at least thirty (30) days before any modification becomes effective. Your continued use of our site, following the posting of conspicuous notice of any modification, will be subject the Terms in effect at the time of your use. You will review these Terms periodically. Your continued use of our site, following the posting of conspicuous notice of any modification, will be your acceptance of the modified Terms. Other terms and conditions may apply to your reservations, bookings and purchases of travel services through our site and to your use of other portions of our site. You will observe these other terms and conditions. If we fail to act with respect to your breach or anyone else’s breach on any occasion, we are not waiving our right to act with respect to future or similar breaches. If a court finds any of these Terms to be unenforceable or invalid, that Term will be enforced to the fullest extent permitted by applicable law and the other Terms will remain valid and enforceable. These Terms, together with those items made a part of these terms by reference, make up the entire agreement between us relating to your use of our site, and replaces any prior understandings or agreements (whether oral or written) regarding your use of our site. The laws of the Turkish Government without regard to its conflict of laws rules, will govern these terms and conditions, as well as your and our observance of them. If you take any legal action relating to your use of our site or these Terms, you agree to file such action only in Turkey and the local courts located in Kusadasi/Turkey. In any such action or any action we may initiate, the prevailing party will be entitled to recover all legal expenses incurred in connection with the action, including but not limited to costs, both taxable and non-taxable, and reasonable attorneys’ fees.

12.17 Corporate, governmental and institutional Users may use portions of the Service for internal printed communications and memoranda.

12.18 Samyeli Travel does not make any promises or guarantees as to the accuracy, completeness, or adequacy of any delay or other air traffic management information on this site, and Samyeli Travel expressly disclaims liability for any errors and omissions.

13. Privacy & Policy

13.1 Samyeli Travel is committed to safeguarding your privacy online. Please read the following policy to understand how your personal information will be treated as you make full use of our many offerings.

Briefly: we will not collect personally identifiable information like your name, e-mail and mailing address and telephone number ("Personal Information") without your knowledge and permission; we will not sell or rent your Personal Information to third parties unless it is specifically stated otherwise. We will take reasonable steps to protect the security of the personal Information we collect from you.

14. Sharing Personal Information

14.1 Some personal information is gathered from you during reservation. Samyeli Travel asks for your name, email address, birth date, gender, zip code, and personal interests. The more information you volunteer (and the more accurate it is), the better we are able to present you the best choices for your travel. Generally, we only disclose your Personal Information to the travel providers that you decide to make arrangements with through our site. For example, when you purchase a fun item or reserve a rental car or hotel room, we will provide the entertainment company, car rental agency or hotel, as the case may be, with the Personal Information needed to process your transaction. We use our reasonable efforts to ensure that these travel providers will also protect your Personal Information. We contract with other companies to perform various functions necessary to operate our business - for example, to deliver tickets, ship items and process credit cards. We will share with these other companies only that Personal Information they require to fulfill your orders. These companies agree that they will not use or disclose that Personal Information for any other purpose. Other than as explained in this policy, we will not disclose any Personal Information we collect from you to others without your permission, except in certain limited circumstances: (a) to protect the security of our site and our rights under our Terms and Conditions of Use; (b) to protect ourselves against liability; (c) in response to legal process, (d) if we believe in good faith that the law requires it; or (e) in connection with a sale of our business or company.

15. Children

15.1 Children - in fact minors (individuals under 18 years of age) - are not eligible to use the services available on our site.
