Please read these Terms & Conditions of use carefully before using or obtaining any materials, information, products or services through this site.

Samyeli Travel (Damlacan Limited) offers access to and use of our site to you subject to your acceptance of these terms and conditions. By accessing, using or obtaining any content, data, materials, information, products or services through our site, you agree to observe these Terms.

The following outlines the terms and conditions upon which you will be making a booking with Samyeli Travel.  These terms and conditions are in place to outline the extent of our services and our responsibilities as well as safeguard our customers’ interests.  These terms and conditions cover all Anzac Day Tours (2, 4, 5-A, 5-B, 6, 6-T, 6-K, 8-A, 8-B, 9, 16 Day Anzac Tours) and all associated services relating to these such as transportation, transfers, accommodation (as part of the tour and additional nights), additional activities etc.

By making a booking with Samyeli Travel you are agreeing to these terms and conditions and accepting them on behalf of all persons within your booking group.  As the principal client making the booking you are obliged to: (1) Bring these terms and conditions to the attention of all others in the party; (2) Establish their needs in relation to travel insurance. (3) Become principally liable to Samyeli Travel for the cost of the holiday.

1.  Payment

 1.1 To secure your place on an Anzac Day tour you are required to pay a non-refundable deposit of 25% of the total booking amount.  You are free to pay the full amount of the tour at time of booking which will be subject to the cancellation policy as outlined below under ‘Cancellation’ in the event that you choose to cancel your booking prior to departure.  Full payment must be received by 1st April 2015 otherwise Samyeli Travel reserve the right to cancel your booking.  The balance of the payment will be taken on this date automatically for customers paying by credit card and if for any reason that you need to pay by an alternative credit card or multiple cards (in the event of a group booking) then it is your responsibility to inform Samyeli Travel of this before this date.  If paying by bank transfer or travel cheque then please ensure payment reaches us no later than this date.

1.2 All prices are quoted in GBP for convenience of the customer as this reflects the largest demographic of our customers.  Samyeli Travel is based in Turkey and all credit card transactions will be charged in the equivalent local currency (TL: Turkish Lira) based on the exchange rate of the day the booking received (or on the 1st April 2015 for balance payments).  Samyeli Travel is the trading name of ‘Damlacan Limited’ which is what will appear on your credit card statement. 1.3 Confirmation of booking will not be made until payment has been received.  Any customers making payment by Bank Transfer or by Cheque may need to wait up to 14 days for confirmation to be made.  Although you will receive confirmation of booking receipt usually within 48 hours.

1.4 You may book, reserve or purchase travel services or accommodations through our site. To do so, you must provide payment information to us - for example, your credit card specifics like card number, issuing bank, expiration date and cardholder name. All information you provide to Samyeli Travel is transmitted using SSL (Secure Socket Layer) encryption. SSL is a proven coding system that transmits all information provided by you to Samyeli Travel by letting your browser automatically encrypts, or scramble, data before you send it. This scrambled data cannot be read as the information travels over the Internet. When our secure server receives your encrypted personal information, it is translated back into its original form and stored in our off-line database. It guarantees that your credit card information is not transmitted over the Internet again. We've located our off-line database in our data center, to further ensure the safety of all your personal information. Keeping your personal financial information private is vitally important to us. As with all information, Samyeli Travel will never rent or sell your personal financial information.

2.  Cancellation

2.1 All cancellation requests by the customer must be made in writing to Samyeli Travel and cancellations will be subject to a cancellation fee depending on when it is received by Samyeli Travel.  In the event that a customer cancels their booking or any part of their booking then Samyeli Travel will retain the following percentage of the payment which are best estimates of likely losses to SamyeliTravel as a result of your cancellation:

Please note:  If you have paid in full then the appropriate amount will be retained and the difference refunded.  If you have only paid a deposit and you cancel then the difference owed based on the above cancellation schedule will be charged to the credit card and you will be advised in writing that this has been done.

2.2 No refunds for any unused parts of the holiday/ tours - so if you decide to cut short your vacation or don't stay in the hotel, or don't do a particular tour then we will not refund you for the unused parts.

2.3 If after making your booking and receiving confirmation from us, you wish to make any changes to your booking such as hotels or you wish to change to another of our Anzac tours, we will do our best to make the changes you require but cannot guarantee your needs can be met.  Any changes to booking will be subject to a £25 administration fee.

2.4 In certain circumstances we may have to cancel your holiday, if this should happen we would return to you all the money you have paid us. We will not cancel your holiday unless: Your holiday is influenced by events beyond our control such as war or threat of war, riots, strikes, epidemics, bad weather, technical problems to transport, closure of ports, terrorists activities, natural disasters or government action or similar events beyond our control.

2.5 After departure if the running of the tour is hindered by events beyond our control i.e. Strikes, port closures, breakdowns of public transport, delays due to the busy ANZAC period etc. we will not be held liable for compensation, payments or refunds. If for reasons beyond our control we have to change your hotel we will do all within our power to substitute the booked hotel with another of the same standard.

2.6 Samyeli Travel reserves the unconditional right to refuse a booking or terminate a passengers holiday in the event of unreasonable conduct.

2.7 If a member of a booking party is prevented from travelling it might be possible to transfer the booking to another suitable person. The person making the original booking needs to provide written notice at least 50 days prior to the tour departure. Changes cannot be guaranteed and an administration fee of £50 will be charged plus any additional costs that are imposed on the Company.

3.  Insurance & Health

3.1 We strongly suggest you take out comprehensive travel insurance before your departure. Samyeli travel are not responsible for providing customers with individual travel insurance.

3.2 Any passenger suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment required during the tour. Failure to make such disclosure will constitute a breach of these terms and conditions and may result in such persons being excluded from the tour in which case all monies paid will be forfeited and Samyeli Travel will not be liable to pay any compensation whatsoever. If the chosen tour includes a cruise or excursion or transfer by boat of any sort the customer must make it known at the time of booking if he/she is unable to swim. This will not prevent the customer from participating in the tour but will enable Samyeli Travel to take additional precautions for the customers safety at such times as may be appropriate.

4. Passports & Visas

 4.1 You are responsible for ensuring that you have all the necessary travel documents and that they are valid and effective. You will need a current passport that is valid for at least 6 months and the necessary visa documentation. Check with your local embassy or travel agent to get more info on Visas etc.

5. Entrance Fees

 5.1 Unless stated entrance fees are not included in the tour price.

6.  Taxes, Service Charges

6.1 Unless otherwise stated taxes and service charges are included in the tour price.

7. Tipping

 7.1 Tipping is part of the Travel scene. If you are satisfied with the service provided you might wish to show your appreciation by tipping the tour leader and driver at your discretion.

8.  Hotel Accommodation

 8.1 All our hotels are based on 2 people sharing a room. Triple rooms are usually available sometimes; however it may not be possible to provide triple rooms due to the hotel availability. Single travellers who do not wish to have a single room can be put in a twin or triple share. If it is not possible to share, a single supplement will need to be paid.

9. Local Laws

 9.1 All participants in tours operated by Samyeli Travel are expected to obey the laws and regulations of Turkey and any failure to do so will relieve Samyeli Travel of all obligations that it may otherwise have under this agreement.

 10. Complaints

 10.1 If the customer has a complaint about any of the tour arrangements, the customer must bring it to the attention of the tour leader or other representative of Samyeli Travel at the time so that they may use their reasonable endeavours to rectify the situation. Failure to do so at the time will affect the customers ability to claim compensation. Should the problem remain unsolved a complaint must be made in writing to Samyeli Travel within 28 days of the completion of the tour.

 11. Customers Special Requests

 11.1 If a customer has any special requests then they should inform Samyeli Travel at the time of booking.  Samyeli Travel and its suppliers will try to meet such requests but, as these do not form part of this agreement and cannot guarantee that they can be met.
